BEWA Fashion UK operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). BEWA Fashion UK is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. Nothing in these Terms affects your statutory rights as a consumer under the laws of England, Wales, Scotland or Northern Ireland, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years old, or are using the Services under the supervision of a parent or guardian, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services in our online store. However, please note that colours or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration.

All products sold by BEWA Fashion UK are of satisfactory quality, fit for purpose, and as described, in accordance with the Consumer Rights Act 2015. Nothing in this Section 2 limits or excludes those statutory rights.

Descriptions of products are subject to change at any time without notice at our sole discretion, and we reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis. This does not affect orders you have already placed and had confirmed.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. BEWA Fashion UK reserves the right to accept or decline your order (for example, in cases of suspected fraud, pricing errors, or stock unavailability) before it is accepted. Your order is not accepted until BEWA Fashion UK confirms acceptance by email. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting.

Your right to cancel: If you are a consumer shopping from the UK, in addition to our Return & Refund Policy, you have a legal right to cancel most online orders within 14 days of receiving your goods, without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, please contact us using the details in Section 24. If you cancel within this period, you must return the goods to us without undue delay and in any event no later than 14 days after telling us you wish to cancel, and we will refund you (including standard delivery costs) within 14 days of receiving the returned goods or evidence that you have sent them back, whichever is earlier. You will be responsible for the cost of returning the goods unless we state otherwise or the goods are faulty. Some items (for example, pierced jewellery, or items made to your specification, where clearly indicated on the product page) may be exempt from the right to cancel for hygiene or personalisation reasons, as permitted by law. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice, although changes will not affect orders that we have already confirmed. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise stated, prices displayed on the Services are shown in GBP (£) and are inclusive of UK VAT where applicable. Delivery charges, and any customs or import charges that may apply to orders delivered outside the UK, are not included and will be shown separately at checkout or, for international customs charges, may be payable by you on delivery.

In the unlikely event that we have mispriced a product and the correct price is higher than the price stated, we will contact you before dispatch to give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled and refund any amount you have paid.

Prices posted in our online store may differ from prices offered in physical stores or in online or other stores operated by third parties.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our store, and to promptly update this information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorised to use the payment method for the purchase, and (iii) you will pay all charges incurred at the posted prices, including applicable delivery charges and taxes.

SECTION 5 — SHIPPING AND DELIVERY

We will deliver your order to the address you provide within the estimated timeframe shown at checkout or in your order confirmation. All delivery times are estimates only. While we are not liable for delays caused by events outside our reasonable control (such as delays by shipping carriers, customs processing, or extreme weather), if a delivery is significantly delayed you may be entitled to a remedy under the Consumer Rights Act 2015, including cancelling your order and receiving a refund. Risk in the products passes to you once the products are delivered to the address you provided; legal ownership (title) passes once we have received payment in full.

SECTION 6 — INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by BEWA Fashion UK, its affiliates or licensors and are protected by UK and international copyright, trade mark and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input over.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability arising from or relating to your use of optional third-party tools, except where such liability cannot be excluded under UK law.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which those tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites, except where such liability cannot be excluded under UK law. Please review carefully the third party's policies and practices before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the relevant third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

BEWA Fashion UK is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with BEWA Fashion UK. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and BEWA Fashion UK, including any injury, damage, or loss resulting from purchased products and services, save where such exclusion is not permitted by law. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with BEWA Fashion UK, except to the extent such release is not permitted by law.

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and is handled in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. You agree that your Feedback will not infringe any right of any third party, including copyright, trade mark, privacy or other personal or proprietary right, and will not contain defamatory or otherwise unlawful or abusive material, or any computer virus or other malware. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Feedback. Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to update information at any time without prior notice. Where such an error affects an order you have already placed, we will contact you in accordance with Section 4 before proceeding.

You may access and use the Services for lawful purposes only. You must not use the Services: (a) for any unlawful or fraudulent purpose; (b) to violate any applicable UK law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send unsolicited advertising or promotional material ("spam"); (g) to impersonate any other person or entity; or (h) to engage in conduct that restricts or inhibits anyone's use or enjoyment of the Services, or that, as reasonably determined by us, may cause harm to BEWA Fashion UK, Shopify or other users.

The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 15 — DISCLAIMER OF WARRANTIES

While we take reasonable care to ensure it is accurate, we do not warrant the completeness or accuracy of general content (such as blog posts or styling guides), and any reliance you place on such general information is at your own risk.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of the statutory rights implied by the Consumer Rights Act 2015 (including as to satisfactory quality, fitness for purpose and description); or any other liability which cannot be excluded or limited under English law.

Subject to the above, to the fullest extent permitted by law, BEWA Fashion UK, our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors, and Shopify and its affiliates, shall not be liable for any indirect or consequential loss, or for any loss of profits, business, or business opportunity, arising from your use of the Services or any products purchased through the Services. We are not liable for foreseeable losses that are not caused by our breach of these Terms or by our negligence, and our liability for the products you purchase is limited to the price paid for those products, except where a higher limit applies under mandatory consumer protection law.

We only supply products for domestic and private use. If you use products for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

SECTION 17 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless BEWA Fashion UK, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. This indemnity does not apply to the extent any such losses, damages, liabilities or claims arise from our own breach, negligence, or fraud, or where it would otherwise conflict with your rights as a consumer under UK law.

We will notify you of any indemnifiable claim; a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced as a result. We may control the defence and settlement of such a claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will reasonably cooperate in the defence of indemnified claims.

SECTION 18 — SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law, and the unenforceable part will be severed from these Terms; this will not affect the validity and enforceability of the remaining provisions.

SECTION 19 — WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of that right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect of the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including any prior versions of these Terms of Service).

SECTION 20 — ASSIGNMENT

You may not transfer or assign this Agreement, or any of your rights or obligations under these Terms, without our prior written consent. We may transfer, assign, or subcontract these Terms and our rights and obligations, provided this does not reduce the guarantees you benefit from as a consumer under these Terms. We will notify you if this happens.

SECTION 21 — GOVERNING LAW AND JURISDICTION

These Terms of Service, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales. You and BEWA Fashion UK agree to submit to the non-exclusive jurisdiction of the courts of England and Wales, meaning that you may bring a claim to enforce your consumer protection rights in connection with these Terms in England or Wales, or in the courts of the country in which you live, if you live in the UK. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of Scotland or Northern Ireland respectively.

If you are not satisfied with how we have handled a complaint, you may also be able to use an approved Alternative Dispute Resolution (ADR) provider to resolve the dispute; details of relevant ADR providers are available from the Chartered Trading Standards Institute.
